NEW YORK ? This holiday season, Burger King won?t be the only place where you can have it your?way.

It used to be enough for stores to promise discounts up to 70 percent to lure shoppers during the busy holiday period. But the ease of ordering online and the sluggish economy changed that. Americans are no longer impressed by discounts alone. Now they want their shopping just like their fast food: not only cheap, but convenient?too.

That means they?re no longer afraid to walk away from the cashmere sweater with the perfect fit if the store is crowded. They?re unwilling to buy those suede pumps in just the right shade of blue if shipping costs extra. And they cringe at the prospect of carrying around paper coupons; they?d rather pull them up electronically on?smartphones.

Retailers from Wal-Mart to Macy?s are doing everything they can to make it easier for more finicky shoppers to spend during the holidays. Several are opening on Thanksgiving Day. Some are offering free layaway and shipping. Many are matching in-store prices with cheaper online deals. Others are allowing shoppers to buy online and pick up their merchandise in?stores.

It?s the latest effort by stores to court shoppers like Patty Edwards, of Bellevue, Wash. Four years ago, Edwards made all of her holiday purchases online through Amazon because she thought it was the easiest way to shop. But this year, she plans to go elsewhere because stores are offering more shipping?options.

?Now I?m not necessarily tied to Amazon,? said Edwards, a retail analyst and principal at investment firm Trutina Financial. ?I can go to Nordstrom, Saks or Target and have stuff available to pick up. It?s a pretty simple process. That wasn?t the case four or five years?ago.?

The have-it-your-way approach is partly a response to fear. Merchants are concerned that shoppers will spend less freely this season because of worries about high unemployment and a package of tax increases and spending cuts known as the ?fiscal cliff,? which will take effect in January unless Congress passes a budget deal. The changes also come as the growth of smartphones and tablet computers has made it easier to browse and?buy.

That puts pressure on brick-and-mortar retailers, which count on holiday shopping for up to 40 percent of their annual revenue, to get shoppers into stores. It?s becoming an increasingly difficult feat: The National Retail Federation estimates that overall sales in November and December will rise 4.1 percent this year, below last year?s 5.6 percent growth. But the online part of that is expected to rise 17 percent, according to research firm?comScore.

This isn?t the first time stores have had to up the ante. As Americans cut back on spending during the economic downturn, merchants ramped up their already deep?discounting.

Shoppers became addicted to the ever bigger sales, and they began fleeing to online?retailers.

To better compete, brick-and-mortar stores concluded that they would have to replicate their online rivals? formula. Shopping needs to be cheap and easy, they figured. So stores began trying new ways to make shopping more convenient last year, such as free shipping and expanded?hours.

This holiday season, they?ve expanded the scope and scale of those incentives to?include:

? Expanded hours for shoppers who can?t wait to hit the mall. ? More shipping and return options: About 44 percent of retailers are offering free shipping this year, a jump from 12.5 percent last year, said Vicki Cantrell, executive director of Shop.org, the National Retail Federation?s digital retail division that tracks retailers? online offers. And UPS said retailers also are working to make returns easier by including return labels in packages or providing a link online that customers can use to print?labels.

? Layaway plans for financially strapped shoppers: Shoppers have typically been charged a fee for layaway programs that allow them to pay over a period of?weeks.

? Price matching for shoppers who are addicted to deals: Small mom-and-pop stores long have offered to match the cheaper prices that customers find online, but this year many big merchants will do the?same.

Explanation:
Its not really as hard as it looks, I swear. What you see is a list of every character that is known now. What you o do is give a synopsis of how your character feels about them. After their name copy/pasta the symbol corresponding with your the relationship. Afterwards, give a quote in italics. Something that your character would say to them. Or something they'd say about them in an interview. Afterwards, give a brief summary of something your character would say when asked how they feel about the corresponding character.

There's a lot of characters and a Character Relationship Chart makes it easy for everyone to keep up with where their characters stand with everyone else's.

Tension for Xstrata board as Glencore deal nears finish line

LONDON (Reuters) - Commodities trader Glencore is set to all but clinch its $30 billion takeover of Xstrata this week, despite a potential snub for the miner's board if, as expected, investors scrap a controversial pay plan for its managers.

Shareholders in both Glencore and Xstrata , the world's fourth-largest diversified miner, will vote in Switzerland on Tuesday.

European competition regulators will decide by Thursday whether to give the green light to one of the sector's biggest ever acquisitions, or begin a longer probe.

After nine months of unexpected twists and wrangling between Xstrata and its top shareholders - not to mention years of on-off talks between the miner and trader - the deal is moving towards the finish line, a victory for Glencore's boss, top shareholder and the deal's chief cheerleader, Ivan Glasenberg.

The deal's prospects were boosted last week thanks to support offered by Xstrata's second-largest investor, Qatar, overcoming initial reticence over the terms of the deal.

Glencore, Xstrata's top shareholder, has separately offered up antitrust concessions, in the hope of securing an EU nod.

"There are hurdles, but they are not insurmountable. I would be very surprised if the deal didn't go through," analyst Chris La Femina at Jefferies said.

Shares in the two groups closed on Friday at a ratio of 2.95 - narrowing in on the ratio of 3.05 shares for every Xstrata share held being offered by Glencore in the all-share deal.

However, a decision by Qatar to abstain from voting on Xstrata's 140 million pound ($222 million) "golden handcuffs" plan to tie in key management has increased the chances that the proposal - which has ruffled investor feathers - will fail.

Qatar said retaining Xstrata's operational management was of "critical importance" - agreeing with the miner's board, which has emphasized the group's shift to a strategy led by organic growth.

But the Gulf state decided to abstain, given "the sensitivities concerning governance issues in the UK."

Its decision - a surprise to those who had expected Qatar to stand by its support of Xstrata managers - follows public comments by top institutional investors like Standard Life, which has already said it will vote down the pay plan, blasting a "rapacious management team and a weak board".

As Glencore does not vote, given that Qatar will abstain from voting its 12 percent and only half of the remaining investors need to vote against, investors representing just 27 percent of Xstrata's total shares in issue could block the pay plan.

"If (the pay deal) gets voted down wholeheartedly, it would be a big embarrassment," said a second analyst, who declined to be named.

MUSCLES IN BRUSSELS

One other hurdle Glencore hopes to overcome this week will be the European Union's antitrust authority, with a decision due by November 22.

Some investors had worried a decision to prolong the probe could scupper the deal, but that is now unlikely to be the case if a decision comes after Tuesday's shareholder vote.

Brussels authorities have concentrated on zinc, and demanded concessions last month. But Glencore, which spent seven months in talks with the EU in the hope of avoiding a long probe, has already offered up a sales agreement with zinc producer Nyrstar and a mid-sized zinc plant in Germany - Nordenham.

"Glencore agreeing to give up Nyrstar and sell Nordenham? if that were the proposed remedy, it would likely be good enough. Under (the model which the Commission uses), transaction would not be anticompetitive," La Femina said.

The only major remaining hurdle Glencore faces is antitrust clearance by Chinese authorities, which do not work to fixed deadlines and might delay completion of the deal.

Analysts say the response from China, the world's largest consumer of key commodities, is harder to predict and might include behavioral remedies rather than simple asset sales.

LOS ANGELES (AP) ? Kareem Abdul-Jabbar's skyhook has been captured in bronze for future generations of basketball fans.

Staples Center unveiled a nearly 16-foot-tall statue of the top scorer in NBA history Friday night, immortalizing Jabbar's famed hook shot alongside statues of fellow Los Angeles Lakers greats Magic Johnson and Jerry West.

Abdul-Jabbar pronounced himself humbled and grateful during a ceremony attended by numerous NBA greats ranging from Johnson and Pat Riley to West and Elgin Baylor ? and even Lakers superfan Jack Nicholson.

Abdul-Jabbar is depicted in his signature goggles and the standard 1980s short-shorts below his No. 33 jersey.

Fall Break at Martin Methodist College in Pulaski, Tenn., means many things to many different folks, but for seven students, a faculty member and staff member, it meant traveling to Pennington, Ala., to help rebuild homes destroyed by the 2012 tornados.

Using the United Methodist connectional system, the Disaster Relief coordinator for Alabama-West Florida Conference made the local arrangements for our nine volunteers from Martin. Our task for three and half days was to mud, sand and caulk a house for a gentleman named Tyrone. ? ?

When our team arrived at Tyrone?s home, we couldn?t believe our eyes. On the left side of the property was a three-bedroom house under construction. On the right side of the property stood a trailer with massive dents from when a tornado had picked it up, bent it in several places and placed it back on the ground.

?

Because of the damage, the trailer had been condemned; however, Tyrone still lived there while construction continued on the new house.

?

For the next three days, the team laid spackle on dry wall, let it dry, sanded it down and then repeated the process until the surface felt even. By the third day, the work became very monotonous and we grew a little discouraged when we realized spackling and sanding the dry wall, as well as caulking the siding, would be all that our team would accomplish.

?

We all thought we were going to be making a huge difference in this house, but then we realized the spackling process took longer than expected. Nonetheless, Tyrone greatly appreciated the work because we had taken his new home one step closer to completion.?

?

Unfortunately, we learned that Tyrone?s home may not get finished before cold weather approaches. Some teams from Mississippi that had planned to help build his home got redirected to hometown disaster relief in the wake of Hurricane Isaac.? We took this information to heart and have returned to campus brainstorming fundraising ideas to help get Tyrone?s house finished.

?

All in all, this was a very heart-breaking, heartwarming and heart-fulfilling fall break trip. I learned so much about all God can do just through the simple task of laying on dry wall mud and then taking it off.

?

However, I urge everyone to please continue to pray for Tyrone and all people who may be affected by natural disasters.

The Risk of Documentation Risk Tolerance


There are few products that can be defined to one hundred per cent certainty. A space shot comes close because we are certain about the force of gravity, the amount of fuel to escape the pull of gravity, the weight of the rocket to carry that fuel, etc. There might be some uncertainties because we may have never done it before, but some laws of physics are immutable and therefore certain.

When it comes to business, uncertainty reigns. We may only be sure of one thing: we have a business problem. Hopefully we can be absolutely certain that we have the problem clearly defined, but many times that is not even a sure thing. The requirements document, in any form (use cases, user stories, backlog items or a requirements document) states the solution to that problem in greater or lesser detail. That solution is then elaborated or detailed into greater specifications until the solution team can implement it. As the solution is elaborated, we become more certain of what we are doing and the applicability of our solution to solve the problem, and therefore we remove risk.

While there is always a risk that we are not solving the right problem or that we have not defined the problem well, as business analysts we can remove a lot of risk by making sure the problem is not only defined but agreed to by the business community.

When we define the proposed solution, we also remove some risk?we have an approach to solving the problem so the risk of the problem lasting beyond a specific date is now reduced.

A signatory of a requirements document must understand that there is risk inherent in the document. Whether they are actually aware of this is another matter. In my experience, many signatories have not read the document and will never read the document. And regardless, they assume the document assures them that the risk a problem poses to the organization has been removed or at least will be. The larger the document is, the more assurance they feel that the risks are minimized and that the problem is going to be solved. This ties in with lower risk tolerance for larger budgeted projects; the expectation is that a larger budget buys a bigger requirements document. Just as the quality of the document is judged by its weight (the heavier the better), risk reduction is likely also measured in the same way. Can you imagine the response of that $10M project sponsor receiving a couple dozen index cards that describe the solution and being asked to approve them? Consider: ?As an astronaut, I want to pilot the space ship to the moon and return safely to the earth within the decade so that I can get a ticker tape parade down Fifth Avenue in New York?. (This is not a knock against user stories, but rather a comment on evaluating risk by document, which as Mark suggests is often done).

However, in business requirements, a signature should only mean, ?I agree that this proposed solution will solve the problem. It is the best of the possible solutions we can come up with and I authorize you to proceed with this solution?. To assume that the document itself, no matter how well written, can reduce the risk may be overreaching and giving the document too much credit. Even with all the best practices Mark lists, which should be followed by all definers of business requirements, there is still going to be much more than a ten percent risk that the solution will succeed as defined. The English language has over a quarter million words (according to the OED) and almost each one has multiple meanings. A requirements document, no matter how carefully constructed, will be fraught with ambiguity. That alone creates a high level of risk.

The biggest source of risk is uncertainty. Even if we spend twice the time we asked for to create the requirements document (and we are usually given half the time we ask for, or less), the document would still contain uncertainties. As we gather information to remove uncertainties, additional uncertainties will arise. We are subject to the basic truth of life: the uncertainty of time. We simply do not know what will happen tomorrow.

I think that Mark?s risk tolerance graph is a great guideline to remind us that we can reduce uncertainty by performing the best practices Mark has noted. However, I am uncertain about the percentages Mark assigns, and business analysts can argue forever about what best practices are and what they accomplish. It?s always good to try to simplify a very complex process into some hard-and-fast rules. Human beings like that kind of insulation from uncertainty. Unfortunately, claiming that nine out of ten projects that assiduously follow the best practices listed in the article will be successful is a terribly uncertain and therefore a very risky thing to say. In other words, the model Mark presents has its own risk.

I say this ironically, not negatively. Because Mark has brought up the issue (and the risk) that those reading about risk may decide to reduce the uncertainty of their own requirement documents by following the best practices Mark enumerates and by gathering more information. And that reduces risk. The real question may be whether the project sponsor knows that the extra time (and money) spent performing those practices correlates directly to risk reduction. We are uncertain that the project sponsor has such knowledge, and as Hamlet would say, ?Ay, there?s the rub!? Or perhaps, there?s the risk!

Why Cisco CEO John Chambers Loves Canada

Cisco Systems CEO John Chambers apparently likes the way they do things up north. On a day when his company reported earnings that slightly beat the expectations of analysts and sent Cisco shares up by more than 7 percent in after-hours trading, Chambers said Cisco may take a good portion ? about 82 percent ? of its $45-billion-and-growing pile of cash to Canada.

Canada? Right. Canada. Recall that Chambers has long been a vocal critic of a U.S. policy that taxes corporate profits at 35 percent. Because of this policy, and because companies have a fiduciary responsibility to their shareholders to use their cash in the least-costly manner possible, companies like Cisco, Apple, Microsoft, and others have tended to leave what cash they generate invested outside the U.S. until such time as they can repatriate it at a lower tax rate.

Chambers took this argument to mainstream American TV viewers in an interview with CBS News correspondent Lesley Stahl on ?60 Minutes? last year. Chambers told Stahl that without a lower rate, Cisco would be forced to invest more resources overseas, acquire more non-U.S. companies, and so on.

And he?s done what he said. For just one example, look at NDS, the Israeli video technology company for which it paid $5 billion earlier this year.

Yesterday, Chambers made a point of singing the praises of Canada, where he says Cisco will be taking more of its $45 billion in cash for the purpose of making investments in the coming year. First he said it to Maria Bartiromo on CNBC (see video below), and then on Cisco?s earnings conference call with analysts. And then he said it to me.

Here he is saying it to Bartiromo, but with a new twist: Cisco may take some of its bankroll to Canada, which he called ?the easiest place in the world to do business. ? We need to learn from them.?

Later on, Chambers repeated similar sentiment on Cisco?s conference call. Answering a question from Goldman Sachs analyst Simona Jankowski about the business environment in the face of the fiscal cliff circus that has everyone in Washington all riled up, Chambers quickly pivoted to U.S. tax policy.

?I personally think the fiscal cliff, we?re going to work through that probably with little bit of saber-rattling on both sides. We?re looking more towards the tax policy and if the government is able to instill the confidence in business that allows and ready to invest.

?If I would look at one model, we have to look at very carefully around the world it?s Canada, the easiest place to do business. It doesn?t matter which party is in power, even their provinces, their states. When the national government, Prime Minister Harper gets it the leaders in Ottowa will get it, they drive down through and make it very easy do business there. And you?re going to see us grow our business there as well as invest overall.?

I asked Chambers about his sudden love of all things Canadian in a brief interview last night. ?They have a great education system, and a predictable tax system,? he said.

It?s true: Canada has lowered its federal corporate tax rate to 15 percent, soundly beating the 35 percent rate in the U.S., which is now the world?s highest. Even President Obama is on board with the idea that that rate should be cut. But Chambers has $45 billion burning a hole in his pocket. And from all indications, business is looking up after a few tough years.
